Privacy Policy – Museum of Tolerance Jerusalem Website

  1. SWC Museum Corp. (Private) (Public Benefit Corporation) No. 560036659 (hereinafter: "the Museum of Tolerance" or "the Museum") operates the Museum of Tolerance website available at https://motj.org.il (hereinafter: the "Website").
  2. The Museum of Tolerance places great importance on maintaining the privacy of users of the Website and does its best to protect the Personal Information (as defined below) it collects, maintains and processes (hereinafter: "User"). This Privacy Policy describes the Personal Information that the Museum of Tolerance may collect about Users of the Website, as well as about visitors to the Museum in Jerusalem, the types of Personal Information it collects, purposes for which the Personal Information is collected and processed, and the way in which users of the Website, as the data subjects of such Personal Information, can exercise their legal rights with respect to such Personal Information.
  3. This Privacy Policy is formulated in the masculine gender for purposes of convenience only, but is intended to reference both men and women. Reference in this Privacy Policy to the Website Users shall also apply, mutatis mutandis, to visitors of the Museum in Jerusalem, which shall also be referred to as Users, as applicable.

    For the purposes of this Privacy Policy, "Personal Information" means any information or data concerning users that is collected by the Museum of Tolerance or is provided to it by the User and/or by any party acting on its behalf with respect to or in the framework of use of the Website and/or the services contained therein, including information through which the User can be identified with reasonable effort, whether directly or indirectly, and/or information that is protected in accordance with the Protection of Privacy Law 5741-1981 (hereinafter: the "Privacy Law") (such as: first name, surname, ID number, residential address, shipping address, telephone number, email, order/purchase history, exhibition/activities at the Museum in which the User has participated, etc.). It is hereby clarified that some of the information that may be collected about the User in the framework of his use of the Website does not personally identify the User and is not stored together with Personal Information, such that it cannot identify the User with reasonable effort. This is statistical and/or aggregated data (such as: webpages viewed by the User, time spent on the Website or a particular page on the Website, the type of device with which the User made use of the Website, pages that interested the User, etc.) and is not subject to the provisions of the Privacy Policy.

  1. The User is not legally required to provide the Museum of Tolerance with any Personal Information in connection with the use of the Website, and providing Personal Information is not a prior condition for browsing or for using most services offered through the Website. However, without providing at least certain types of Personal Information, as required by the Museum of Tolerance, the Museum may not be able to offer or provide the User certain services and/or the use of certain services, options, content or information offered on the Website may be limited, including the ordering of products or services (insofar as or with respect to particular products or services), joining of the Museum of Tolerance's subscribers' club, etc. Accordingly, any provision of Personal Information to the Museum by the User is of his/her own free will and consent.
    It is hereby clarified that the Personal Information may be collected directly from the User or through external suppliers that will collect it for the Museum of Tolerance or on its behalf (such as through  platforms of suppliers embedded in the Website e.g., SmarTicket, Eventer, etc.).
  1. Insofar as a User will transfer Personal Information to the Museum of Tolerance about third parties, such User agrees and confirms that he/she has obtained all approvals and consents required from such third parties for the purpose of transferring their Personal Information to the Museum of Tolerance, and that the processing of such Personal Information will take place in accordance with and subject to this Privacy Policy. The User undertakes to indemnify the Museum of Tolerance for any damage incurred by it resulting from a claim or demand against the Museum by any third party (or any other person) in connection with the Museum's processing of such Personal Information.
  2. Personal Information about a User will not be publicly displayed on the Website, other than with the User's explicit consent.
  3. The Personal Information will be maintained in a database controlled by the Museum of Tolerance and which is managed in accordance with applicable law, including the Privacy Law.   4. Purposes

The Personal Information (as well as the non-personal information indicated in Section 3 above), wholly or in part, may be used by the Museum of Tolerance for the following purposes, wholly or in part, as the case may be:

  • Operating the Website;
  • Ordering products or services offered on the Website by the Museum of Tolerance and/or by parties acting on its behalf;
  • Identification purposes (e.g., when contacting the Museum of Tolerance through the Website or through other means of communication);
  • Execution of certain activities on the Website;
  • Development, improvement and management of the Website;
  • In order to make intraorganizational processes at the Museum of Tolerance more efficient, including with respect to the Website and its use;
  • Personalization of the Website to the personal preferences of the User;
  • Making contact, providing support, handling of requests, inquiries and complaints, and response to questions;
  • Analysis, research, control and statistical assessment;
  • Sending of advertisements and marketing materials (subject to receipt of your consent in accordance with Section 30A of the Telecommunications Law (Broadcasts and Transmissions) 5742-1982);
  • Management of the Museum of Tolerance's subscribers' club/mailing list;
  • Defense against claims, demands, complaints and legal processes brought against the Museum of Tolerance and/or parties acting on its behalf, as well as against third parties;
  • Enforcement of the provisions of the Website's Terms of Use and this Privacy Policy;
  • For purposes of compliance with applicable laws and legal and regulatory undertakings of the Museum of Tolerance and/or parties acting on its behalf;
  • Any other legitimate purpose of the Museum of Tolerance that is consistent with the Website's Terms of Use, this Privacy Policy and the relationship between the Museum of Tolerance and that same User.
  1. Transfer of Personal Information to Third Parties
    9.1
    Personal Information will not be transferred to third parties other than in the following specified cases:
  • For purposes of providing services or products that have been ordered through the Website;
  • Insofar as the transfer of the Personal Information is required for the purposes specified in Section ‎8 above, including service providers and external consultants e.g., attorneys, accountants, support services, storage/cloud, computing/IT, banks, etc.;
  • Affiliates of the Museum of Tolerance;
  • If the Museum of Tolerance is required to do so on the basis of a judicial order, a demand by a competent authority or for purposes of compliance with the Museum’s legal and regulatory obligations (such as: courts, law enforcement agencies, tax authorities, etc.);
  • If the Museum of Tolerance receives advance notice of legal proceedings that will be instituted against it due to actions taken by the User as well as in any dispute, claim, complaint, demand or legal processes, if any, between the User and the Museum of Tolerance and/or any parties acting on its behalf;
  • If the Museum of Tolerance will organize its activities in the framework of another entity – including investment, acquisition, merger, reorganization or other structural change in the matter of the Museum's activities in the framework of another entity – it will be entitled to transfer the Personal Information to the other entity, provided that such other entity will undertake to accept the provisions of this Privacy Policy with respect to the User;
  • If a claim or a suspicion arises on the part of the Museum of Tolerance that the User has performed an act and/or omission that damages and/or that may damage the Museum and/or any party acting on its behalf and/or any third parties whatsoever;
  • For purposes of screening and sorting employees and candidates, managing the Museum's recruitment and placement practices, and generally managing employment relations (insofar as the User will choose, for example, to offer his candidacy for employment with the Museum of Tolerance through the Website);
  • In any case in which the Museum of Tolerance will be believe the Personal Information transfer is required or necessary to prevent damage to the Museum, to other Users or to any third parties whatsoever; and –
  • Upon the User's explicit request.
    9.2
    International Transfers

The Museum of Tolerance will be entitled to transfer the Personal Information (wholly or in part) to third parties as specified above that are located outside of Israel, including countries that may provide a different level of data protection than that provided for under Israeli law. By using the Website and transferring the Personal Information to the Museum, the User agrees that the Museum will also be entitled to transfer the Personal Information to such third parties located, or whose processing practices of the Personal Information they will perform for the Museum will be, in such countries.
          9.3
If the Museum will be interested to share or transfer Personal Information to a third party in a manner that deviates from the aforesaid, the User will be contacted beforehand and will be given the option to reject to such transfer, unless the User has already given his/her prior consent for such use.

  1. Other Websites

The Website may provide and include links to other websites that are not associated with it, over which it has no control and for which it is not responsible for the privacy protection practices and policies. The collection and processing of Personal Information through such linked websites are not covered under this Privacy Policy; and Users must carefully review the privacy policies of these linked websites, as transferring any Personal Information through such websites is under the User's full and exclusive responsibility; the Museum is not responsible for any matters associated with the privacy policies and/or the collection and processing practices of personal information through such linked websites.

  1. Advertisements/Marketing Messages

The Museum of Tolerance offers a service for the receipt of newsletters, updates and various content through, inter alia, email, SMS, messaging applications (such as WhatsApp) or other means of communication (subject to the receipt of consent in accordance with Section 30A of the Telecommunications Law (Broadcasts and Transmissions) 5742-1982). Users who wish to enroll in this service in order to receive information, updates or various advertisements from the Museum of Tolerance may request through the online form available here  https://forms.motj.org.il/welcome?lang=en . The User may at any time withdraw his/her consent and discontinue receipt of such messages by contacting the Museum via e-mail at info@motj.org.il or through the unsubscribe mechanism that will be included in each update, notification, newsletter, etc.

  1. Privacy Rights of Users (as data subjects)

In accordance with the Privacy Law, any person is entitled to review Personal Information maintained about him in a database, by himself, by a representative authorized by him/her in writing, or by his/her legal guardian. A person who has reviewed Personal Information about himself and finds that it is incorrect, incomplete, unclear or out-of-date may request the data controller of the database to amend or delete such information. In order to exercise the privacy rights regarding their Personal Information in accordance with the Privacy Law, Users may contact the Museum of Tolerance by email  info@motj.org.il.

  1. For internal purposes only, the Museum of Tolerance may add a date, time, type of browser, type of operating system, IP addresses of website visitors, page address in which the visit has been made and the address of the referring page. This information is stored in aggregate for purposes of website management, for load balancing of the Website server and for producing statistical reports. The User will be identified on the basis of this information only in unusual cases in which the Museum believes in good faith that such identification is necessary due to danger to human life or in order to prevent serious harm to the physical or mental health of a user or other person. The IP addresses are not associated with identifying personal details in the Museum of Tolerance servers.
  2. Cookies
  • The Website may use cookies for routine and standard operating purposes, including in order to collect statistical and aggregated data about website usage, to verify details, for data security purposes, for advertising and marketing purposes, etc.
  • Cookies are text files that the User's browser creates based on commands from the Website computers or from third-party computers. Some cookies expire when the browser closes and others are stored on the hard disk of the terminal device serving the User. Cookies may contain a variety of data such as preferred language, entry details, pages visited, time spent on the Website or on a specific page, how the User reached the Website, information that the User asked to see during entry onto the Website, etc.
  • The default setting of most browsers makes it possible to receive cookies, but modern browsers include the option of abstaining from receiving cookies (of any type or of a certain type) through browser definitions. (One can, for example, redefine the browser so that it will refuse to accept cookies or to define it so that it will indicate when cookies are sent to the computer.). However, users should know that neutralizing cookies may bring about a condition in which the Website or other websites, or some of the applications, services and contents of the Website (or other websites) cannot be used or in which some of the applications and services on the Website will not operate properly.
  • For your information – the Museum of Tolerance uses essential cookie files on the Website that are intended for website functioning [and] performance cookie files that are designed to enable the Museum of Tolerance to count visits and sources of traffic in order to measure and improve website performance. (The information that is collected in these cookie files is cumulative and anonymous.) The Museum of Tolerance may also be assisted by and use cookies originating from third parties (such as Google Analytics, social networks, Facebook, Tik-Tok, Instagram, etc.) or other third parties that are intended to present advertisements and announcements about products or services based on the various activities of the User on the Website and/or throughout the Internet and websites, and other services that they have visited, etc. Cookies may occasionally be sent to the User from the Museum of Tolerance’s advertisers or business partners. It is hereby clarified that the Museum of Tolerance does not control these cookies and is not responsible for them or for any matter associated with them.
  1. Data Security

The Museum of Tolerance takes and applies various security measures based on customary standards and as required by applicable law. However, and as is well-known, while these measures reduce the risk of unauthorized intrusion and data leaks, they do not provide complete security since the storage and transfer of data by electronic means (including through the Internet) will never be completely safe. Therefore, the Museum of Tolerance does not undertake that the Website will be completely immune, and by the very use of the Website, the User consents thereto and affirms that he is aware of the inherent risks associated therewith.

  1. Data Retention Information retention period

The Museum of Tolerance will retain the Personal Information for as long as required to achieve the purposes described in Section ‎8 above, unless a shorter or longer data retention period is required or permitted under applicable law.

  1. Changes to the Privacy Policy

The Museum of Tolerance will be entitled to modify the terms of the Privacy Policy from time to time. The Museum will publish on the homepage of the Website a notice regarding material changes  14 days prior to their entry into force. Regarding other non-material changes made to the Privacy Policy – the last update date will be indicated in the Privacy Policy (on which such changes have entered into force). Continued use of the Website after a change in the Privacy Policy constitutes proof of the User's consent to the revised/amended Privacy Policy. Insofar as the User does not consent to the revised/amended wording of the Privacy Policy, he must abstain from making any further use of the Website.
